SAN JOSE, California, June 3 /PRNewswire/ -- Finjan Inc., a leader in secure web gateway products and the provider of a unified web security solution for the enterprise market, announced today that the United States Patent and Trademark Office (PTO) has terminated the re-examination proceedings and issued a Notice of Intent to Issue Ex Parte Re-examination Certificate (Notice) in the re-examination of its U.S. Patent No. 6,092,194 for a system and method for protecting a computer and network from hostile downloadables. The Notice indicates that all claims of this security patent have been confirmed as being patentable by the PTO.

The Notice indicates that the PTO found that the art cited by the third party requestor and other art provided through information disclosure statements could not be combined to reject any of the 68 issued claims and thus upheld the patentability of all of the originally issued claims that were challenged in the re-examination proceeding. With the termination of the re-examination of U.S. Patent 6,092,194, the issued claims have now been subjected to two separate examinations, by independent groups of patent examiners, and have been held to be patentable in both instances.
The 6,092,194 patent was held to be valid and infringed by Secure Computing in early 2008 by the U.S. District Court in Delaware.
